Florida Supreme Court Certified Circuit Court Mediator Eric is into his fourth decade as a Florida lawyer. He has tried numerous cases to verdict, so he truly understands the risks of going to trial and the benefit of the mediation process. In the beginning of his career, most of the cases Eric handled were in the area of personal injury and wrongful death litigation, including products liability and medical malpractice cases. More recently, most of Eric’s work has been in the area of insurance coverage and bad faith litigation.

Eric has been Board Certified in Civil Trial Law by the Florida Bar since 1993. He is “AV” rated by Martindale-Hubbell and has been named as a “Florida Super Lawyer” in insurance law, one of only approximately 20 lawyers statewide to receive this recognition, in 2008, 2009, 2011, 2014 – 2020.

Jose G. Rodriguez, a Florida Bar Board Certified Civil Trial lawyer, is also a Certified Florida Circuit Court Mediator whose mediation practice concentrates on civil cases with an emphasis on personal injury, wrongful death, medical malpractice, product liability and worker’s compensation cases. In addition to being a Florida Supreme Court Certified Circuit Court Mediator, Don has been a litigator and trial lawyer in the state of Florida for over 40 years. During that time he has represented plaintiffs and defendants including patients and healthcare providers in medical malpractice cases, litigating, and trying cases throughout the state of Florida.

As a trial attorney he is aware of the risks and uncertainties a trial brings and the benefits of mediation and a mediated settlement.

For most of his career, Don’s areas of concentration were medical malpractice and personal injury.

More recently, he has added subrogation litigation arising out of homeowners claims representing both plaintiff and defendant carriers.

As a young lawyer, I attended a meeting of the Florida Defense Lawyers Association and heard a talk by a prominent plaintiff’s attorney. The attorney spoke of the thread that binds litigators together. How no one other than another litigator truly understands what a litigator goes through in discovering, preparing, and trying a suit.

I believe that. I greatly respect what litigators do, the efforts litigators put into their cases, and their concern for their clients and the law. Even though we are adversaries, litigators should not and need not be enemies.

I bring those beliefs to my mediations. The lawyers on both sides and their clients are entitled to respect, courtesy and my best efforts to resolve their cases.

Philip G. Thompson has over thirty years of trial experience in the areas of personal injury (including medical malpractice, wrongful death and premises liability), workers compensation, Social Security disability and general civil litigation matters. He has tried over fifty cases to verdict in various jury and non jury matters. Phil still has an active trial practice where he represents both plaintiffs and defendants in a wide variety of administrative and general civil matters. Phil has also been providing title and closing services as an agent for the Attorneys Title Fund since 2006. Phil is also a Florida Supreme Court Certified Circuit Civil Mediator.

Mediator Ira S. Bergman is a Florida Supreme Court Certified Circuit Civil Mediator. He began his legal career over 27 years ago as a judicial law clerk at the 15th Circuit in West Palm Beach, and thereafter worked as an insurance litigator in New York City and Philadelphia. He returned to South Florida in 2007, where he continued to litigate a wide range of insurance cases, both first-party and third-party.

Mr. Bergman’s multi-faceted background as a coverage attorney makes his perspective on mediation unique. Mr. Bergman has a deep understanding of the insurance industry and the factors that motivate both claimants and insurers to settle cases. By establishing rapport with the parties through candid communications, he develops effective resolution plans that are acceptable to opposing parties in mediation.

Throughout his career, Mr. Bergman has developed and executed strategic resolution plans for thousands of pre-litigation disputes and litigated cases. He has undertaken multiple roles in the mediation process as decision-maker, mediator and counsel of record. Mr. Bergman’s most satisfying work has been the facilitation of negotiated resolutions of multi-party disputes.

As an insurance coverage lawyer, Mr. Bergman advised insurers regarding appropriate handling and resolution of matters across the country. He has drafted policy language, managed coverage and bad faith litigation, and represented insurers in a wide range of coverage disputes and litigation. His coverage litigation experience is highly diverse, spanning first-party coverage litigation over damage caused by Hurricanes Wilma and Irma, third-party coverage litigation concerning liabilities arising out of asbestos, lead paint, tobacco and construction defects, and many other types of insurance disputes.

Shelliann is our Scheduling Coordinator for mediations but also handles a variety of administrative and marketing tasks for the office. She comes to us with over 9 years’ experience as a Legal Secretary in the area of foreclosure defense. Shelliann is proud of her ability to excel in all areas of the legal assistant field and makes everyone feel like they are her favorite client. Originally from Jamaica, she lives in Tamarac with her husband. She is very involved in her church, loves to travel, and is an avid photographer of the outdoors. Her dream vacation is to travel to Paris with her best camera equipment.

Joanne is originally from New Jersey. And yes, she is married to Mediator, Eric. She received her degree in Brooklyn, NY as a Licensed Optician in 1983. Although the two have been busy raising their 3 beautiful daughters, Joanne has worn many hats over the years. Quickly transitioning into the role of Operations Manager for Eric’s law firm, she provides administrative, marketing and bookkeeping support for his busy office. Her additional ventures have included video production and owning an e-commerce soup business.
